Jenkens & Gilchrist, Paul C. Watler, and Timothy J. Goodwin (collectively referred to as "Jenkens") bring an interlocutory appeal from the trial courts denial of their motion to compel arbitration. In their interlocutory appeal, Jenkens raises two issues: (1) whether the Texas General Arbitration Act applies to this lawsuit; and (2) whether the arbitration agreement at issue requires arbitration of this lawsuit. Jenkens also brings a petition for writ of mandamus presenting two similar issues: (1) whether the Federal Arbitration Act applies to this lawsuit; and (2) whether the arbitration agreement at issue requires arbitration of this lawsuit. This Court consolidated the interlocutory appeal with the mandamus petition. Because we conclude the arbitration agreement does not apply to the claims in this lawsuit, we need not decide whether the Texas General Arbitration Act or the Federal Arbitration Act applies. We therefore deny the petition for writ of mandamus, and affirm the trial courts order denying Jenkenss motion to compel arbitration.
